Suffolk County District Attorney Raymond A. Tierney today announced that David Marmol, 41, of Lindenhurst, was sentenced to 10 years in prison after he was convicted by a jury in December 2022, of possessing over one half ounce of cocaine with the intent to sell it, as well as heroin, fentanyl, and a metal knuckle knife.
“This defendant’s prior convictions for drug dealing did not stop him from again being caught with illegal drugs packaged for sale,” said District Attorney Tierney. “Hopefully this prison sentence will serve as a deterrent to those who think about continued criminal activity. My office is committed to working with law enforcement to ensure dangerous drugs and drug dealers are kept off the streets of Suffolk County.”
The evidence at trial established that on February 20, 2021, Suffolk County Police Department uniformed officers stopped Marmol for a traffic violation while he was operating a rented 2020 Ford Expedition in the vicinity of South Fifth Street and Montauk Highway in Lindenhurst. When the officers approached Marmol’s vehicle, they detected an odor of marijuana emanating from inside the vehicle. During a subsequent search of the vehicle, the officers recovered an illegal metal knuckle knife from the center console.
Marmol was arrested and transported to the First Precinct, where upon further search, he was found in possession of 20 bags of cocaine collectively weighing in excess of one-half ounce, as well as four bags containing quantities of heroin and fentanyl.
On December 2, 2022, Marmol was convicted by a jury after a week-long trial held before Supreme Court Justice, the Honorable Timothy P. Mazzei, of two counts of Criminal Possession of a Controlled Substance in the Third Degree, a Class B felony, Criminal Possession of a Controlled Substance in the Seventh Degree, a Class A misdemeanor, and Criminal Possession of a Weapon in the Fourth Degree, a class A misdemeanor.
On July 11, 2023, he was sentenced to 10 years in prison followed by three years of post-release supervision. Marmol was represented by Peter Brill, Esq.
Marmol was previously convicted of Attempted Criminal Possession of a Controlled Substance in the Fifth Degree in 2010, Robbery in the Second Degree in 2001, and Criminal Sale of a Controlled Substance in the Fifth Degree in 2000.
The case was prosecuted by Assistant District Attorney Dennis Wouters of the Narcotics Bureau.
Criminal complaints and indictments are merely accusatory instruments. Defendants are presumed innocent until proven guilty. No one is above the law.
