South Huntington Man Pleads Guilty to Drugging, Forcibly Raping His Biological Daughter

Suffolk County District Attorney Raymond A. Tierney today announced that a 45-year-old South Huntington Man pleaded guilty to Rape in the First Degree, for forcibly sexually assaulting his 21-year-old daughter.
“Not only did this defendant commit a horrific crime, but he violated his duty as a father when he sexually assaulted his own daughter,” said District Attorney Tierney.  “This plea ensures that the defendant will serve a lengthy prison sentence for his actions and the victim will not have to relive the trauma she experienced by testifying at a trial.”
According to court documents and the defendant’s statements, in February 2022, the victim was spending time with her father when he encouraged her to spend the night at his house. The defendant gave her an Advil PM so that she could rest.  The victim was awakened from her sleep by the defendant rubbing her back and her buttocks.  When the victim realized what the defendant was doing, he pinned her arms down and forcibly raped her.  The victim fled from the house and ran for help from another family member who lived nearby. The police were notified and the victim disclosed that the defendant had previously sexually abused her when she was a young child.
On May 31, 2023, the defendant pleaded guilty before County Court Judge, the Honorable Karen M. Wilutis, to the charge of Rape in the First Degree, a Class B violent felony. He is due back in court on July 19, 2023, when he is expected to be sentenced. He is being represented by Michael Elbert, Esq.
This case is being prosecuted by Assistant District Attorneys Breanna McIntyre and Katherine Flinchum of the Child Abuse and Domestic Violence Bureau, with investigative assistance from Suffolk County Police Department Detective Michael Volpicelli of the Second Precinct Squad.
Criminal complaints and indictments are merely accusatory instruments. Defendants are presumed innocent until proven guilty. No one is above the law.
